Magical Remedy and Drugs Act

In our daily life we always go through these kinds of misleading advertisement under which the person claims to provide remedy through any kavach or tabiz etc.

Directly or indirectly it is concerned with the sentiment of the person who is completely exhausted due to the struggle of life. Anyway, in reality there is a separate legislation which deals with such kind of false advertisements.

The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 prohibits any kind of misleading advertisement of any drugs or magical remedies which mislead the public at large. Certain provisions of the Act are as follows

1. ‘magic remedy’ includes a talisman, mantra, kavacha, and any other charm of any kind which is alleged to possess miraculous powers for or in the diagnosis, cure, mitigation, treatment or prevention of any disease in human beings or animals or for affecting or influencing in any way the structure or any organic function of the body of human beings or animals;

2.  The Act prohibits the Advertisement of Certain Drugs for Treatment of Certain Diseases and Disorders as:

a.  procurement of miscarriage in women or prevention of conception in women; or

b. the maintenance or improvement of the capacity of human beings for sexual pleasure; or

c.  the correction of menstrual disorder in women; or

d.  the diagnosis, cure, mitigation, treatment or prevention of any disease, disorder or condition specified in the Schedule

3.      The act also prohibits the Misleading Advertisements Relating to Drugs.

4. Any person whoever contravenes any of the provisions of this Act [or the rules made there under] shall, on conviction, be punishable –

a. in the case of a first conviction, with imprisonment which may extend to six months, or with fine, or with both;

b. in the case of a subsequent conviction, with imprisonment which may extend to one year, or with fine, or with both.

Our legislation has provided us the numerous options to get rid of these types of person. Alas! rather than loving we fear god…. fear will keep the  people in existence….
